By accessing or using Bellcast ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and businesses that access or use Bellcast. "You" refers to the individual or entity using the Service on behalf of a business.
Bellcast is an AI-powered front office platform designed for local businesses. The Service includes:
Features available to you depend on your subscription plan. We reserve the right to modify, add, or remove features at any time with reasonable notice.
Bellcast offers subscription-based pricing at flat monthly rates. Current plans range from $99/month (Starter) to $199/month (Pro) to $299/month (Premium). Plan details and pricing are available at bellcast.polsia.app/pricing.
Subscriptions are billed monthly in advance. You authorize us to charge your payment method on file on each billing date. All fees are in US dollars and exclusive of applicable taxes.
If a payment fails, we will notify you and may suspend access to the Service until payment is received. Repeated payment failures may result in account termination.
We may offer a free trial period. At the end of the trial, your subscription will automatically begin and your payment method will be charged unless you cancel before the trial ends.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. You retain access to the Service until the period ends.
All fees are non-refundable except where required by law or at our sole discretion. We do not provide prorated refunds for partial months. If you believe you were charged in error, contact us at bellcast@polsia.app within 30 days of the charge.
We may change subscription prices with 30 days' advance notice. Continued use of the Service after the price change takes effect constitutes acceptance of the new price.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
You retain ownership of all data you submit through the Service, including call recordings, messages, customer information, and business configuration ("Your Data"). You grant us a limited license to process Your Data solely to provide and improve the Service.
The Service may record, transcribe, and process calls and messages to fulfill its features (e.g., booking appointments, generating responses). By using the Service, you confirm you have obtained all legally required consents from parties to those communications, including any consent required for recording under applicable state law.
You are the data controller for your customers' personal information. You are responsible for ensuring your use of customer data through the Service complies with applicable privacy laws, including notifying customers of AI-assisted communications where required.
We use Your Data to operate the Service, improve AI model performance (in aggregate and anonymized form), and communicate with you about the Service. We do not sell your personal data or your customers' data to third parties.
We implement industry-standard security measures to protect data. However, no system is perfectly secure, and we cannot guarantee absolute security of Your Data.
We retain Your Data for the duration of your subscription and for a reasonable period after termination as required by law or for legitimate business purposes. Upon request, we will delete Your Data in accordance with our data deletion procedures.
Bellcast uses artificial intelligence and large language models to generate responses to calls, messages, and customer inquiries on your behalf. You acknowledge and agree that:
We recommend regularly reviewing call transcripts and message logs to ensure AI responses align with your business standards and comply with applicable regulations.
Bellcast and all associated software, algorithms, designs, trademarks, and content are owned by us or our licensors. Nothing in these Terms transfers any intellectual property rights in the platform to you. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
You retain all ownership rights in Your Data and any content you create or upload to the Service. You grant us a limited license to host, process, and display Your Data as necessary to operate the Service.
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.
We strive to keep Bellcast available and performant, but we do not guarantee any specific level of uptime or service availability. The Service is provided "as is" and "as available."
We may perform scheduled or unscheduled maintenance, updates, or modifications that temporarily interrupt the Service. We will make reasonable efforts to notify you of planned downtime in advance.
We are not liable for any losses or damages resulting from Service interruptions, outages, or degraded performance, whether caused by maintenance, technical failures, third-party service providers, or circumstances beyond our control.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in full.
You may terminate your account at any time by canceling your subscription and contacting us at bellcast@polsia.app. Termination does not entitle you to a refund of prepaid fees.

Upon termination, your license to use the Service ends. We will make your data available for export for 30 days following termination, after which we may delete it. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

Any dispute arising from these Terms or the Service will be resolved by binding arbitration on an individual basis, unless you opt out within 30 days of your first use by emailing bellcast@polsia.app with the subject "Arbitration Opt-Out." You and Bellcast waive any right to a jury trial or class action for covered disputes.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, notify you by email or prominent notice in the Service.
Your continued use of the Service after any change constitutes acceptance of the updated Terms. If you do not agree to revised Terms, you must stop using the Service and cancel your subscription.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bellcast regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
Waiver. Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it later.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service failures.
